Warning letter
Under current policy, a Warning Conference would be justified for a licensee who failed to record any redacted or more of ATF Forms 4473 reviewed; However, the Director of Industry Operations may decide a Warning Letter would be appropriate based on the following factors: Significance and number of violations, significance of any improvement since previous inspection, compliance history, time elapsed since previous administrative action , and other relevant factors. This was BPG's first compliance inspection since becoming an FFL in May 2015. BPG predominately provides gunsmith services to non-FFLs; Therefore, BPG had a minimal number of ATF Forms 4473 transfers redacted 4473s) for the inspection period. BPG had redacted repair transactions for which the completion of an ATF Form 4473 was not required. BPG had redactedl instances out of redacted transfers where he failed to record any identification in Section B, item 20a of the ATF Form 4473 that resulted in a 25% error rate (redacted = 25%) for which violations were issued. The FFL conducted NICS checks on the purchasers prior to transfer that resulted in "proceeds." On October 25, 2016, IOI redacted conducted OpenFox queries on both purchasers. The results of the queries did not disclose derogatory information. Based on the following facts, it is recommended that only a Report of Violation and Warning Letter be issued in lieu of a Warning Conference: This was BPG's first compliance inspection: the majority of BPG's firearm transactions (90%) involve the return of repair firearms to their owner; BPG has not had any traces and Mr. Haught, Managing Member now understands the importanct to ensure all information required is recorded on the ATF Forms 4473.
